Terms of Use

These terms govern access to MotoAI Malaysia, including car discovery, dealer workspaces, MotoAI Agent, communications, referrals, and related services. By using MotoAI, you agree to these terms and the Privacy Notice.

1. Acceptance and operator

You must read these terms before using MotoAI. If you do not agree, do not use the service. OWNER REVIEW REQUIRED: insert the registered legal name, company number, and Malaysian address of the MotoAI operator before publication.

2. Eligibility

You must be at least 18 and able to enter a binding agreement. If you use MotoAI for a dealer or business, you confirm that you are authorised to bind that organisation. Additional onboarding or verification may apply to dealer, partner, finance, payment, or internal tools.

3. Marketplace role

MotoAI provides technology for discovery, communication, workflow, and referrals. Unless expressly stated in a confirmed written order, MotoAI is not the seller, buyer, dealer, lender, insurer, workshop, inspector, transporter, or payment provider. Listings, matches, estimates, Agent plans, availability, and status indicators are informational and require verification. A vehicle, finance, product, or service contract is formed only when the relevant parties confirm it under their own terms.

4. Accounts and security

Provide accurate information, keep access credentials and verification codes confidential, and promptly report suspected misuse. You are responsible for activity under your account to the extent permitted by law. We may require identity, authority, dealer, listing, or transaction verification and may refuse unsafe or incomplete requests.

5. Listings and user content

You retain ownership of content you submit. You grant the operator a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, display, distribute, and use it only to operate, secure, promote, and improve MotoAI and the relevant listing or request. You confirm that content is accurate, lawful, non-infringing, and that you have permission to submit personal data and images. We may label, moderate, pause, remove, watermark, or correct presentation without assuming responsibility for the underlying offer.

6. MotoAI Agent and automated output

Agent suggestions, rankings, summaries, price or monthly estimates, readiness scores, drafts, and generated actions may be incomplete or wrong. They are not legal, financial, insurance, mechanical, safety, or professional advice. Review important facts, inspect vehicles and work, obtain professional advice where appropriate, and approve each material action before it is carried out.

7. Communications and consent

You authorise service messages needed for your account or request through the channels you choose, which may include web notifications or WhatsApp. Marketing requires the consent or other permission required by law and can be declined. Messages may be delivered by third-party networks and are not guaranteed to be immediate or error-free.

8. Prices, payments, and partners

Prices, instalment figures, fees, stock, appointment times, rewards, and financing indications are estimates or partner information unless expressly confirmed. Taxes, delivery, third-party fees, eligibility checks, and partner terms may apply. Payments may be handled by a separate provider. Refunds, cancellations, warranties, and fulfilment follow the confirmed order and applicable law. Do not pay outside an approved flow unless you independently verify the recipient.

9. Acceptable use

Do not use MotoAI unlawfully; impersonate others; submit false, misleading, discriminatory, infringing, malicious, or unsafe content; scrape or bulk-extract data; bypass access controls; probe security; interfere with service; send spam; manipulate leads, rankings, reviews, attribution, or rewards; or use personal data beyond the purpose for which it was provided.

10. MotoAI rights

The service, software, design, branding, databases, and operator-created content are owned by or licensed to the operator and protected by applicable law. These terms give you a limited, revocable, non-transferable right to use MotoAI for its intended purpose; they do not transfer intellectual-property rights.

11. Privacy

The Privacy Notice explains how personal data is processed. Dealers and service partners may provide separate notices for their own processing. Do not place unnecessary sensitive data in free-text fields or uploads.

12. Availability and disclaimers

MotoAI is provided on an as-available basis. To the extent permitted by Malaysian law, we do not guarantee uninterrupted access, a particular match or sale, partner performance, vehicle condition or title, finance approval, revenue, search ranking, delivery, or the accuracy of third-party information. Nothing in these terms excludes guarantees, rights, or remedies that cannot lawfully be excluded.

13. Liability

To the extent permitted by law, the operator is not liable for indirect, incidental, special, punitive, or consequential loss, lost profit, lost opportunity, or third-party conduct. Any liability cap and exclusions must be confirmed by the owner and Malaysian counsel before launch. Liability is not limited where doing so would be unlawful, including for fraud or other non-excludable responsibility.

14. Suspension and termination

You may stop using MotoAI at any time. We may restrict, suspend, or terminate access to protect users, comply with law, investigate risk, enforce these terms, or discontinue a feature. Where reasonable, we will give notice. Provisions intended to survive, including ownership, payment, records, disclaimers, and liability terms, continue after termination.

15. Malaysian law and disputes

These terms are governed by Malaysian law. Contact us first so the parties can try to resolve a dispute in good faith. Subject to mandatory consumer rights and any owner-approved dispute process, Malaysian courts have jurisdiction.

16. Changes

We may update these terms for service, legal, security, or commercial changes. We will post the updated date and give additional notice where required. Continued use after the effective date means you accept the revised terms; if you do not accept them, stop using the service.
